Usage Policy for Chobigen

This Usage Policy governs the activities permitted and prohibited when using Chobigen (“Chobigen”, “we”, or the “Service”). By accessing or using the Service, you agree to comply with these requirements. This policy is to be read together with the Terms and Conditions and the Privacy Policy, which address the contractual terms of use and the handling of information respectively.

1. Purpose and Application

Chobigen provides AI-powered image generation tools for lawful, ethical, and responsible use. This policy applies to the purposes for which requests are submitted, the materials supplied with those requests, and the use of the resulting content. A permitted category of work does not create an exemption from the restrictions stated elsewhere in this policy.

Eligibility to use the Service remains governed by the Terms and Conditions, including the requirement that users be at least 18 years old. The descriptions of acceptable activities below do not authorize use by a person who does not satisfy those eligibility requirements.

2. Commercial and Creative Activities

You may use the Service to create product images, advertisements, social media visuals, banners, posters, and marketing materials for legitimate purposes. You may also prepare design assets for personal, business, or client projects. The permission concerns the category of activity and remains subject to lawful inputs, compliant content, and responsible use of the resulting material.

Commercial use is not a representation that every generated image is fit for publication or that all rights required for its use have been obtained. The user remains responsible for reviewing the deliverable, its context, and the materials incorporated into the request before publication or distribution.

3. Concept Development and Client Work

The Service may be used to develop mockups, prototypes, visual concepts, presentation materials, and campaign ideas. These activities may assist in exploring a design direction or preparing a proposed creative treatment. Their preliminary or conceptual character does not remove the obligation to comply with the prohibitions in this policy.

You may use Chobigen for authorized client deliverables provided that you have the legal right to use all input materials. A client’s involvement does not transfer your responsibility for the submission to Chobigen, and the fact that material was supplied by a client does not itself establish that its use is authorized.

4. Unlawful and Harmful Activities

You must not use the Service to violate any applicable law or regulation or to promote or facilitate violence, terrorism, abuse, or criminal activity. This restriction concerns both the purpose of a request and the role the generated material is intended to perform. Describing a request as a creative exercise does not permit conduct that falls within these prohibited purposes.

5. Sexual, Explicit, and Exploitative Content

Chobigen does not support or provide NSFW or adult content generation. Nudity, sexually explicit material, content intended to arouse sexual interest, and fetish or pornographic content are prohibited. Non-consensual or exploitative content is likewise prohibited. Any sexual or explicit depiction involving a minor is strictly prohibited under all circumstances.

An attempt to generate prohibited material may result in enforcement even where the request does not produce a completed image. These restrictions apply to deliberate attempts to obtain the prohibited result and must not be treated as a description of an optional or separately available adult-content feature.

6. Misrepresentation, Impersonation, and Fraud

You must not impersonate real individuals in misleading, harmful, or defamatory ways. Fake endorsements, forged documents, deceptive materials, scam content, and fraudulent visuals are prohibited. The restriction applies where the generated material is used to create a false impression of identity, approval, authenticity, or other material circumstances.

The availability of image generation or editing capabilities does not authorize the creation of misleading evidence or the attribution of statements, approvals, or conduct to a person who has not supplied them. Users remain responsible for the context in which an image is presented, not only for the wording of the original prompt.

7. Political Manipulation

The Service must not be used to create political propaganda or influence campaigns, manipulate public opinion, elections, or civic processes, or produce misleading political or social messaging. These prohibited purposes are not made permissible by describing the resulting content as advertising, campaign design, or ordinary social media material.

8. Intellectual Property and Authorization

You must not upload or use copyrighted materials, logos, brand assets, or personal images without authorization, or generate outputs intended unlawfully to replicate protected works. The user must have the legal right to use the material supplied to the Service. Access to an image or the ability to download it does not by itself establish that right.

Permission to undertake commercial or client work under this policy remains subject to these requirements. Chobigen does not guarantee that the output is original or free from rights held by another person, and the user must evaluate those matters before relying on the material.

9. System Abuse and Unauthorized Access

You must not attempt to bypass restrictions or safeguards, automate excessive requests in order to overload or exploit the system, scrape or access other users’ data, or interfere with the security or integrity of the Service. These prohibitions apply to activity carried out through the ordinary interface as well as automated activity directed at the Service.

A technical ability to submit a request or reach a resource is not permission to access another user’s information or circumvent an imposed restriction. The Service must be used within its safeguards and the limits applicable to the relevant account or feature.

10. User Review and AI Limitations

You are solely responsible for submitted prompts and inputs, uploaded images and materials, generated outputs, and the use, publication, or distribution of the resulting content. You must ensure that your activities comply with the laws applicable in your jurisdiction. This responsibility continues after the generation request has completed.

AI systems may produce inaccurate, biased, or unintended results, and the same prompt may produce different results on different occasions. Originality, legality, and suitability for a particular purpose are not guaranteed. You must review outputs before using them in business, advertising, or public communication rather than treating successful generation as evidence that review is unnecessary.

11. Unintended Prohibited Outputs

Chobigen is not designed or marketed for generating adult or explicit content. Automated systems may occasionally produce unintended outputs, but such behavior is not supported. Detection systems may block or remove the material, and users must not intentionally attempt to generate content prohibited by this policy.

The appearance of an unintended result does not amend the policy or establish that the Service offers that category of content. The distinction between system behavior and permitted use must be maintained when assessing whether a proposed request is compliant.

12. Third-Party Processing

Chobigen may rely on third-party AI providers, including Google Gemini or similar technologies. By using the Service, you consent to your information being processed by those providers in connection with your requests and acknowledge that Chobigen does not control their systems. Further information about data handling is set out in the Privacy Policy.

13. Monitoring, Review, and Detection

We do not pre-screen every prompt or output. We may monitor, review, or analyze activity to detect abuse, enforce policies, and investigate security or payment issues. Detection systems may be incomplete or inaccurate, and the absence of a warning or block does not establish that particular content is permitted.

Monitoring is an enforcement mechanism and not a substitute for the user’s own review. You must assess compliance before submitting a request and before using its result, irrespective of whether an automated safeguard intervenes.

14. Enforcement Measures

If we detect or reasonably suspect a violation, we may block or cancel requests, remove generated content, suspend or terminate accounts, restrict or revoke access to features, and limit or remove credits. These actions are taken at our sole discretion in connection with enforcement of this policy.

The measures described are not a promise that every violation will receive a particular sequence of warnings or restrictions. A request may be subject to action before a completed output is available where the detected or reasonably suspected conduct itself violates the policy.

15. Credits and Refunds for Violations

Activity that violates this policy consumes applicable credits or usage limits and is not eligible for refunds, reversals, or compensation, except where required by applicable law as recognized in the Terms and Conditions. Users are responsible for ensuring compliance before submitting a request; enforcement against a prohibited request does not, by itself, make the consumed credits refundable.

16. Legal Cooperation

We may cooperate with law enforcement authorities, regulators, or government agencies when required by applicable law. Information handling associated with that cooperation is subject to the descriptions in the Privacy Policy and the Terms and Conditions.

17. Policy Amendments and Acknowledgment

We may update this policy at any time to reflect product changes, patterns of abuse, and legal or regulatory requirements. Continued use of the Service after an update constitutes acceptance of the revised policy. Questions concerning these requirements may be submitted through the contact page.

By using Chobigen, you acknowledge that you understand and agree to this Usage Policy, accept responsibility for your actions and content, and undertake to use the Service in a lawful and responsible manner. The availability of the Service is conditional on compliance with the applicable Terms and policies.
