This Privacy Policy sets forth the provisions governing the collection, use, storage, disclosure, and protection of information in connection with Chobigen (“Chobigen”, “we”, “our”, or the “Service”). By accessing or using the Service, you acknowledge and agree to the information handling described herein. This policy should be read together with the Terms and Conditions and the Usage Policy.
1. Scope and Application
This Privacy Policy applies to information handled in connection with Chobigen’s AI-powered image generation service. References to the Service encompass the submission of prompts and reference materials, the processing of image generation requests, and the account and operational functions associated with those activities. The policy describes the purposes for which information may be handled; it does not constitute a guarantee that every category of information described below is collected in every interaction.
Chobigen acts as a service provider. Responsibility for the prompts, uploaded materials, generated outputs, and subsequent use or distribution of those outputs remains with the user. The handling of information in order to operate the Service does not amount to approval of the user’s content or intended use.
2. Information Supplied by Users
We may collect the text prompts you submit, images or reference materials you upload, and account information such as your email address and username. These materials may be associated with the requests, accounts, or projects to which they relate. Information supplied as part of a reference image or prompt falls within this description even where its inclusion is incidental to the principal purpose of the request.
We may also collect payment-related information in connection with the purchase or use of credits. Payments are processed through third-party providers. The reference to payment-related information in this policy should therefore be read together with the provisions concerning third-party processing, rather than as a representation that Chobigen independently processes every aspect of a payment transaction.
3. Automatically Collected and Generated Information
When you interact with the Service, we may automatically collect your IP address, device and browser type, and usage records containing requests, timestamps, and actions. Cookies and similar tracking technologies may also be used in connection with those interactions. Such information may describe the technical circumstances in which a request was made and the manner in which the Service was accessed or used.
We may retain generated images, the prompts and metadata associated with them, and processing logs. Generated data is distinct from the material originally uploaded by a user, but both categories may be handled together where required for the operational purposes described in this policy.
4. Purposes of Processing
We use collected information to provide and operate the Service, process image generation requests, and administer accounts and usage. These purposes include the operational handling of the inputs and outputs associated with a request and the records necessary to understand the use of the Service.
Information may also be used to enforce policies, prevent abuse, monitor system performance and reliability, and comply with legal obligations. A single record may be relevant to more than one of these purposes, for example where an operational log is also relevant to an investigation of misuse or a security incident.
5. Third-Party AI and Service Providers
Chobigen uses third-party technologies, including AI providers such as Google Gemini or similar services, to process requests. By using the Service, you acknowledge and agree that your prompts, inputs, and related information may be transmitted to such providers in connection with the requested processing.
Those providers may maintain their own privacy policies and data handling practices. Chobigen does not control the manner in which third-party systems process or store information and is not responsible for third-party data handling beyond what is required to provide the Service. Statements about Chobigen’s own practices must not be construed as guarantees concerning every independent provider.
6. AI Training and Sale of Information
Chobigen does not use your prompts, uploaded images, or generated outputs to train AI models. We do not sell your data for AI training purposes, and we do not sell personal data. These statements concern Chobigen’s own use and disclosure of information.
Third-party AI providers may operate under separate policies governing the information they receive. We do not control or guarantee their data usage practices. The absence of training by Chobigen must therefore not be interpreted as an assurance concerning independent processing undertaken by a third-party provider.
7. Storage, Retention, and Deletion
We may store user information, prompts, generated images, and logs for operational purposes. Outside the specific deletion-request process, the duration of retention may be limited or undefined depending on system requirements, legal obligations, and security considerations. We reserve the right to delete information at any time or retain it as necessary for compliance, dispute resolution, or enforcement, and we do not guarantee permanent storage.
Requests to delete account information, images, prompts, projects, or related records are addressed in the Terms and Conditions. Under that process, certain information may be retained where necessary for security monitoring, fraud prevention, abuse investigation, legal compliance, or dispute resolution for a period not exceeding one year after the deletion request or account deletion. The Terms also explain subsequent deletion or anonymization, reasonable processing time, and the temporary presence of residual backup copies.
8. Sharing and Disclosure
We may share information with providers supporting cloud hosting, AI processing, analytics, and other service operations described in this policy. We may also disclose information in order to comply with legal obligations, court orders, or valid government requests. These disclosures are distinct from selling personal data, which Chobigen does not do.
Information may further be disclosed to protect the rights, safety, or security of the Service, its users, or others, including in connection with fraud prevention, abuse detection, or security incidents. All disclosures will be limited to what is reasonably necessary for the relevant purpose.
9. Cooperation with Authorities
We may cooperate with law enforcement authorities, regulators, or government agencies when required by applicable law. Cooperation may include disclosure of user information where legally required. We may not be able to notify affected users of such disclosures in every case; this policy does not promise advance notice of every request or disclosure.
10. Security Measures and Residual Risk
We implement reasonable technical and organizational measures to protect user information. Such measures do not eliminate every risk associated with networked services. No system is completely secure, and unauthorized access, data breaches, cyberattacks, or other compromises may occur notwithstanding the measures employed.
We do not guarantee absolute security, and use of the Service is at your own risk. You are responsible for maintaining the confidentiality of your account and securing your devices and credentials. Users are advised to avoid submitting sensitive or confidential information, particularly information that they would be unable to tolerate being retained or exposed.
11. Data Breach Disclaimer
To the maximum extent permitted by applicable law, Chobigen is not liable for loss, damage, or harm resulting from unauthorized access, data breaches, system compromise or hacking, or the loss or corruption of information. This provision is subject to the stated legal limitation and must be read together with the liability provisions in the Terms and Conditions; it is not a representation that mandatory legal obligations cease to apply.
12. Cookies and Similar Technologies
We may use cookies and similar technologies to maintain sessions, improve the user experience, and analyze usage patterns. Session-related use concerns continuity of interaction with the Service, while usage analysis concerns understanding how the Service is used. You may manage cookies through your browser settings.
13. International Processing and Transfers
Your information may be processed and stored in different countries depending on the infrastructure and third-party services used to operate Chobigen. The location from which you access the Service does not necessarily determine the location of processing or storage. By using the Service, you consent to the transfers described in this section.
14. Minimum Age and Children’s Privacy
Chobigen is intended only for users who are at least 18 years old. Persons under 18 are not eligible to use the Service. We do not knowingly collect personal information from children. If such information is identified, we may delete it and restrict access to the Service.
15. Amendments and Continued Use
We may update this Privacy Policy at any time. Changes take effect upon posting, and continued use of the Service following an update constitutes acceptance of the updated policy. The effective date and update information appearing with the policy identify the published document; users should consult the policy when assessing the terms applicable to their continued use.
