Terms and Conditions for Chobigen

These Terms and Conditions (“Terms”) govern access to and use of Chobigen (“Chobigen”, “we”, “our”, or the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service. The Privacy Policy explains information handling, and the Usage Policy sets out the conduct permitted and prohibited in connection with the Service.
1. Nature and Scope of the Service
Chobigen provides automated, AI-powered tools through which users may generate images on the basis of text prompts, uploaded images, and other inputs. The Service relies on automated systems and third-party technologies. Its operation does not constitute a representation that Chobigen controls, approves, or guarantees every result produced in response to a request.
The availability of a feature or the successful completion of a request does not establish that the resulting material is accurate, original, lawful, or suitable for the user’s intended purpose. The allocation of responsibility for inputs, outputs, and subsequent use is set out below and applies equally to personal, commercial, and client-related work.
2. Eligibility and Capacity
You must be at least 18 years old and possess the legal capacity to enter into a binding agreement in order to use the Service. Persons under 18 are not eligible to use Chobigen. Parental or guardian consent does not create an exception to this minimum-age requirement.
By accessing or using the Service, you represent that you satisfy these eligibility conditions. The minimum-age requirement applies to the use of the Service itself and is not limited to the purchase of credits or the use of paid features.
3. Account Information and Credentials
You agree to provide accurate and current account information and remain responsible for maintaining the confidentiality of your credentials. All activity conducted under your account is your responsibility, including requests submitted and content processed through that account. The use of an account does not relieve you of the obligation to secure the devices and credentials through which it is accessed.
We may suspend or terminate accounts at our discretion, including in the circumstances described in the suspension, security, and enforcement provisions of these Terms. Account access remains subject to compliance with these Terms and the Usage Policy.
4. Responsibility for Inputs and Outputs
You are solely responsible for every prompt, input, image, and other material you submit to the Service. That responsibility extends to generated outputs and to any subsequent use, publication, or distribution of those outputs. You must comply with all laws and regulations applicable to your activities.
Where content is prepared for a business or client, the fact that Chobigen generated the image does not transfer responsibility for the deliverable to Chobigen. You remain responsible for reviewing the output and for determining whether you have the necessary authority to use the input materials and the resulting content.
5. Acceptable Use and Prohibited Conduct
Your use of Chobigen must comply with the Usage Policy. You must not generate illegal, harmful, or deceptive content, attempt to generate NSFW or other prohibited content, engage in political manipulation or misinformation, violate intellectual property rights, or abuse or interfere with the Service.
These restrictions apply to attempts as well as completed outputs where the applicable policy prohibits an attempt. A request’s acceptance by an automated system, or the absence of an immediate enforcement action, does not constitute permission to disregard the Usage Policy.
6. AI Limitations and Non-Deterministic Results
AI systems may produce inaccurate, biased, unintended, or otherwise unsuitable results. They do not guarantee originality or legal compliance. You use generated content at your own risk and must assess it before relying on it in advertising, commercial activity, public communication, or other work.
Generation is probabilistic rather than deterministic. Identical or substantially similar inputs may produce different results on different occasions, and reproducibility is not guaranteed. Chobigen is not responsible for variations in output, and a previous result does not establish an entitlement to obtain that result again.
7. No Adult or Explicit Content Offering
Chobigen does not provide or support the generation of adult or sexually explicit content. Where such content or an attempt to obtain it is detected, requests may be blocked and accounts may be restricted. Credits associated with policy-violating requests are not refundable, subject to any refund required by applicable law.
8. Credits, Payments, and Refunds
The Service may operate through credits or usage limits. Credits are consumed upon submission of a request. The submission of a request therefore has a usage consequence independently of whether the user ultimately elects to publish, distribute, or otherwise use the resulting material.
All payments are final unless a refund is required by law. Credits used for completed requests or requests blocked because of policy violations are not refundable. These provisions must be read subject to any mandatory legal entitlement; they do not exclude refunds that applicable law requires.
We may change pricing, plans, or credit structures at any time. The description of a particular pack or usage arrangement does not constitute a guarantee that the same pricing or structure will remain available indefinitely.
9. Third-Party Technologies
The Service relies on third-party providers, including AI systems such as Google Gemini or similar technologies. By using Chobigen, you consent to the processing of your data by those providers in connection with the Service and acknowledge that Chobigen does not control their systems.
Chobigen is not responsible for third-party services. Information handling is further described in the Privacy Policy, including the distinction between Chobigen’s own practices and practices independently maintained by third-party providers.
10. Data and Storage
We may store prompts, generated images, processing logs, account information, and usage records in connection with operation of the Service. Storage is not guaranteed to be permanent. The presence of material in an account or project at a particular time does not constitute a commitment to retain that material indefinitely.
11. Requests for Data Deletion
You may request deletion of account information, generated images, prompts, projects, or related data through available account settings or by contacting us. Deletion requests are not processed immediately. We may require a reasonable period to verify the request, perform the necessary system operations, and address applicable legal and security obligations.
A deletion request and the completion of deletion are distinct events. Submission of the request does not itself establish that all active records, logs, and backup copies have been removed at that moment. The retention and residual-copy provisions below explain the limitations applicable to that process.
12. Retention Following Deletion Requests
Even after a deletion request has been submitted or an account has been deleted, certain information may be retained for a limited period not exceeding one year where necessary for security monitoring, fraud prevention, abuse investigation, legal compliance, or dispute resolution. This period concerns the stated post-deletion-request purposes and is not a promise of permanent storage for the user’s benefit.
After that retention period, information will be permanently deleted or anonymized within a reasonable timeframe. Residual copies may remain temporarily in backups and will be removed through standard system processes. Immediate or complete removal from backup systems and logs required for security or legal purposes is not guaranteed.
To the maximum extent permitted by law, Chobigen is not liable for delays in deletion, retention within the stated period, or residual information in backups or system logs. You remain responsible for deleting content you no longer wish to store and for avoiding submission of sensitive information for which you may later require immediate deletion.
13. Security and Assumption of Risk
We implement reasonable security measures, but no system is completely secure. Data breaches, unauthorized access, and system failures may occur notwithstanding those measures. You use the Service at your own risk, subject to the provisions of these Terms and any obligations that cannot be excluded under applicable law.
14. Limitation of Liability
To the maximum extent permitted by applicable law, Chobigen shall not be liable for generated content; loss, damage, or harm arising from use of the Service; data loss, breaches, or system failures; third-party service behavior; or business, financial, or reputational losses. These exclusions concern the categories stated and are subject to the governing limitation imposed by applicable law.
To the maximum extent permitted by law, Chobigen’s total liability, if any, is limited to the amount paid by you during the preceding 30 days. Nothing in the wording of this limitation should be read as excluding a liability that applicable law does not permit to be excluded or restricted.
15. Indemnification
You agree to defend, indemnify, and hold Chobigen harmless from claims arising out of your use of the Service, your content or generated outputs, or your violation of these Terms. This obligation concerns claims connected with the conduct and materials for which you bear responsibility under these Terms.
16. Suspension and Termination
We may suspend or terminate access at any time, including where these Terms are violated, abuse or risk is detected, or legal or security considerations require action. Access restrictions may affect an account or its ability to use the Service. The existence of an account or a credit balance does not excuse compliance with these Terms.
17. Legal Cooperation and Disclosure
We may disclose information when required by law, regulation, or a valid legal request and may cooperate with law enforcement or government authorities. The handling of information in those circumstances is also addressed in the Privacy Policy.
18. Monitoring and Enforcement
We do not pre-screen all content, but we may monitor activity to detect abuse. Enforcement measures may include blocking requests, removing content, suspending accounts, and revoking credits. A failure to detect or act on a particular request immediately does not amount to a representation that the request complies with these Terms.
19. Intellectual Property and Processing License
You retain rights to your inputs and generated outputs, subject to applicable law. This provision does not guarantee that an AI-generated output is eligible for intellectual property protection, is original, or is free of third-party rights. Those matters remain subject to the applicable law and the circumstances of the material concerned.
You grant Chobigen a limited license to process your content for the purpose of operating the Service. The license described here is tied to service operation and should be read alongside the Privacy Policy’s explanation of processing and AI training practices.
20. Availability and Modification
Chobigen does not guarantee continuous availability, error-free operation, or uninterrupted access. The Service may be modified, suspended, or discontinued at any time. These limitations apply to the operation of the Service and do not create an assurance that any particular feature or workflow will remain available indefinitely.
21. Amendments to These Terms
We may update these Terms at any time. Continued use of the Service constitutes acceptance of the updated Terms. Users should review the published Terms when deciding whether to continue accessing the Service following a revision.
22. Governing Law
These Terms are governed by the applicable laws of the operating jurisdiction. References to rights, restrictions, and liability in this document are to be read subject to applicable law. This section does not designate a particular court, arbitration body, or dispute venue.
23. Contact and Final Acknowledgment

By using Chobigen, you acknowledge that you understand the risks of AI-generated content, accept responsibility for your use, and agree that the Service is supplied on an “as is” basis without the guarantees excluded in these Terms.
